"Earlier this year, we integrated our military search service with one of the leading legal case management systems (CMS) in default servicing space, KMCIS' CaseAware(R) solution, to seamlessly populate our search results into their CMS," said Scott Stoddard, CEO of Quandis. "However, not all law firms currently have the IT staff and time needed to configure the data fields on their end, yet they have a burning need to ensure they comply with the SCRA. This plug-in enables them to immediately take advantage of our service with zero IT resources until they have the time to map the fields in their CMS to achieve a fully integrated solution. In short, it's a very effective alternative to circumvent waiting for an integration to be completed; and, it's very quick to implement."

The new SCRA solution works by adding Quandis' plug-in to the user's Microsoft Excel application. The searching is conducted within the spreadsheet by invoking the Quandis' military search API to scrub for active duty military personnel. Active borrowers identified are instantly returned back into Excel to alert the user to halt foreclosure proceedings. If the plug-in had not been built, law firms would be forced to perform the searches manually on the Department of Defense's Web site.

Notable is that in 2011 Quandis officially released its military search service as a standalone application for use by servicers and foreclosure attorneys. Quandis then took the solution a step further by integrating it with one of the industry's leading CMSs. The Surgeons of Lake County, LLC ("Surgeons") announced today that an unauthorized user had gained access to - and encrypted - their server in an attempt to force payment from Surgeons in exchange for the password needed to regain access to the server.

Surgeons learned of the incident on June 25, 2012, when it discovered that an unauthorized user had gained remote access to a server containing Surgeons' corporate email and electronic medical records. The unauthorized user posted a message on the server stating that the contents of the server had been encrypted and could only be accessed with a password that would only be supplied if Surgeons made the demanded payment. Upon receiving the demand, the server was turned off, and has not been turned back on.

Surgeons officials immediately contacted law enforcement and began an investigation of the incident. In the wake of this incident, Surgeons is undertaking additional measures to strengthen and enhance its protocols to ensure the security of patient records.

"Safeguarding every patient's personal information is a top priority at The Surgeons of Lake County," said Scott C. Otto, M.D., President of The Surgeons of Lake County, LLC. "We are devoting significant people and technological resources to help protect patient confidentiality."

Surgeons believes that the intention of the unauthorized access was to extort payment from Surgeons, not to take patient information, and Surgeons is not aware of any reports that the information contained on the server has been misused as a result of this incident.

Still, the unauthorized user had the ability to access names, addresses, Social Security numbers, credit card numbers, and certain medical information; and, as a result, Surgeons began mailing notification letters today to individuals who may have been affected. Surgeons is offering them one year of free credit monitoring services, as well as call center support.

Appellate Court Reverses Securities Fraud Claim and Permanent Bar Against Former FINRA Board Member Richard Goble

The Eleventh Circuit Court of Appeals has reversed a District Court's Judgment which found that former FINRA board member Richard Goble, founder and owner of North American Clearing, Inc. ("NACI") engaged in securities fraud, announced his counsel Eric Lee of Lee & Amtzis, P.L. The Appellate Court also reversed the injunction and permanent bar issued by the District Court against Goble.

NACI was a Florida corporation founded in 1995 with its principal place of business in Longwood, Florida. NACI was a correspondent brokerage firm registered with the SEC since 1995. NACI acted as the clearing firm for approximately 40 small brokerage firms and cleared transactions for more than 10,000 customer accounts valued at more than $500 million. At the time the SEC filed its original Complaint in 2008, Goble had no compliance or regulatory violations nor any prior warnings by FINRA or the SEC. Goble was a member of FINRA's board of directors. GOBLE was also a vocal critic of actions being taken by FINRA at the time, including actions taken by Mary Shapiro who later became head of the SEC. As a result of the SEC's action, Goble was forced to resign from the FINRA Board.

On May 27, 2008, the SEC obtained an asset freeze and other emergency relief due to allegations of fraudulent misconduct at NACI. The SEC filed a Complaint against GOBLE, NACI's President, Bruce B. Blatman ("Blatman"), and its former financial and operations principal, Timothy J. Ward ("Ward"), charging them with fraud and other securities laws violations. The SEC's Complaint alleged that the defendants engaged in illegal activities, including the misuse of customer funds, in order to hide NACI's financial problems and to pay for its daily business operations. In addition to the asset freeze, the SEC obtained a temporary restraining order against the defendants and an order appointing a receiver over NACI.

After a five day trial in May 2010, on April 27, 2011, the District Court entered its bench trial opinion, which found Goble liable for committing securities fraud and for aiding and abetting securities laws violations. The District Court permanently restrained and enjoined Goble for violating securities rules and regulations and barred Goble from engaging in the securities industry in the future. In its April 2011 opinion, the District Court rejected the SEC's argument that NACI improperly sold customer money market funds to pay its daily operating expenses. However, the District Court found that Goble committed securities fraud based on a single May 13, 2008 transaction, which also resulted in its finding that Goble aided and abetted securities laws violations.

In its decision, the Eleventh Circuit found that the transaction at issue was not the result of any misrepresentation and that the transaction was not in connection with the purchase or sale of securities. The Eleventh Circuit thus determined, as a matter of law, that Goble did not commit securities fraud. The Eleventh Circuit affirmed the claim that Goble aided and abetted Ward and Blatman in violating the books and records requirements of Section 17(a) of the Exchange Act, 15 U.S.C. § 78q(a), and Rule 17a-3, 17 C.F.R. § 240.17a-3, which required NACI to maintain accurate records. The Appellate Court also vacated the District Court's injunction that barred Goble from procuring a securities license, engaging in the securities business or violating § 10(b) or Rule 10b-5. The Court also vacated portions of the injunction requiring compliance with the Exchange Act rules.

The Eleventh Circuit's opinion, issued almost four years to the day after the SEC shut down NACI, vindicates Goble. Based on the District Court's original Judgment and the Eleventh Circuit's reversal, the SEC shut down a substantial clearing firm that had over 40 correspondent brokers and serviced over 10,000 customer accounts based solely on a single incident of a books and records violation.

Today a Federal court denied the appeal of Leader Technologies in the Leader v. Facebook patent infringement case. "This is suspiciously convenient timing for Facebook, coming hours after the Facebook roadshow commenced in New York," said CEO Mike McKibben, referring to Facebook's IPO kickoff yesterday.

According to McKibben, a lower court held that Facebook violated Leader's patent on 11 of 11 claims, but then invalidated Leader's patent by finding that Leader had tried to sell its technology too soon ("on-sale bar," in legal parlance.)

"Leader asked the Federal Circuit to overrule this verdict, because the company's patent interests were protected by a 'no-reliance' agreement that negated any possibility of making offers before we had signed contracts," said McKibben. "But the court ignored these agreements, accepted Facebook-doctored evidence, and misquoted my testimony to justify their decision."

"We are extremely disappointed," McKibben added. "The appeals process is supposed to correct legal errors by juries, not simply root around for new evidence to justify not overturning a jury that was fooled by Facebook tricks."

McKibben may appeal to the U.S. Supreme Court. "We firmly believe that the jury erred in their one finding against Leader," he says. "Facebook is using our invention, as the jury agreed, without our permission. This court just condoned hacking of intellectual property and fabrication of evidence as acceptable business practices."

The case is Leader Technologies Inc. v. Facebook Inc., 2011-1366, U.S. Court of Appeals for the Federal Circuit (Washington). The lower court case is Leader Technologies Inc. v. Facebook Inc., 08-cv-862, U.S. District Court, District of Delaware (Wilmington).
