Technical terms are avoided or clearly explained. References to judicial opinions and statutes are with few exceptions omitted. Humor is not.

The new articles deal with the following: Advanced Planning for Divorce, Perils of Small Business Incorporation, Complex Construction Defect Litigation, Enforcing a Judgment, Mechanic's Lien Fundamentals, Enforcing and Defending Mechanics Liens, and Understanding the Notice to Perform found in the standard California residential purchase and sale agreement. Attorney Stan Prowse has also included an easy to understand section outlining Civil Litigation in California. This informative section outlines the meaning behind Civil Litigation, the processes of a lawsuit, mediation and the differences between the two as well as what to expect from the California civil courts. The new web site also contains an autobiography of Mr. Prowse. While in London the delegation will be featured at five music acquisition sessions for American television and film productions, and meet with national and international music organizations and with government agencies, including the American Embassy, which are working to strengthen the protection of intellectual property rights.

NARIP brings popular film and television music supervisors, Andrea von Foerster (The OC, Grey's Anatomy) and Chris Mollere (Vampire Diaries, Pretty Little Liars) to London to conduct a series of educational programs for the British music industry. These programs create an opportunity to develop relationships and encourage the use of British music in American television and film productions.

Both supervisors actively seek music for current American projects, and music publishers, record executives, personal managers and others will present music to them in London for consideration. Skinner, who was sentenced to death for a 1995 triple murder, has a scheduled execution date of November 9.

"We, the undersigned, are alive today because some individual or small group of individuals decided that our insistent and persistent proclamations of innocence warranted one more look before we were sent to our death by execution. We are among the 138 individuals who have been legally exonerated and released from death rows in the United States since 1973, and some of us were exonerated because of DNA evidence," the exonerees said in the letter. The group also reminded Perry that he signed SB 122 into law, a measure which is intended to ensure that DNA will be tested, if available, to prove someone's innocence.

In a recent op-ed in the Huffington Post, Witness to Innocence member Kirk Bloodsworth, the first DNA exoneree in a capital conviction in the U.S., echoed these sentiments. "The only reason my name was cleared, and the right man brought to justice, is because prosecutors agreed to test the evidence. I am living proof that when scientific evidence is available, there is simply no excuse to refuse testing," he said.

"Like Troy Davis in Georgia, there are some real questions regarding the Hank Skinner case. The state of Texas does not know whether Skinner committed the crime because they did not test his DNA," said David A. Love, Executive Director of Witness to Innocence. "If Texas doesn't want to risk killing a potentially innocent man, then Gov. Perry has no choice but to stop the execution and allow for the DNA test."

Jay Fenello, a homeowner who has been working on a mortgage modification with Bank of America for over 18 months, today announced that he has filed a pro se legal action against the bank, alleging 13 causes of action including Fraud, Bad Faith, Equitable Estoppel, and violating numerous state and local laws, including the Fair Debt Collection Practices Act (FDCPA), the Truth In Lending Act (TILA), and the Real Estate Settlements Procedure Act (RESPA).

He also claims that the bank is violating the Cease and Desist Order that Bank of America signed with the Comptroller of the Currency on April 13, 2011.

The most egregious allegation made by Mr. Fenello is that the purported note holder, a mortgage-backed security, has faced no damages due to the six credit default swaps that insured the performance of tranches within the trust. If true, there would be no basis for the bank's foreclosure action, and could possibly implicate the bank in a pattern of racketeering.

Concurrent with today's announcement, Mr. Fenello also announced two new websites, http://OccupyTheCourts.org and http://ProSeAction.org . Naperville, Illinois trial attorney Mark W. Mathys of LAW OFFICES OF MATHYS & SCHNEID obtained a jury verdict against two doctors on behalf of his client Micheatria Donelson last week (October 6, 2011); case NO. 07-CI-01768. In February 2006, Donelson went into labor after just 21 weeks of pregnancy, and her child, Prince Embry, was decapitated during the premature delivery.

Mathys alleged that Dr. William Koontz failed to properly treat Donelson's high-risk pregnancy by improperly placing a cerclage, which is a purse string type device to keep the cervix closed and prevent a premature birth. But when that cerclage failed to do its job, Dr. Koontz's partner, Dr. Joseph Bilotta, failed to remove the device when Donelson went into spontaneous pre-term labor. The purse string acted like a noose around the baby's neck during the double-footling breech delivery causing baby Prince's head to be decapitated. Donelson witnessed this entire horrific event, including watching her son's headless body handed to the nurse, the chin ripped off and the head delivered.

As a result of watching her child decapitated, Donelson suffers from post-traumatic stress disorder, anxiety and depression. The $1.4 million award was exclusively for Donelson's past and future pain and suffering related to her emotional injuries.

"Justice was served here today," said Mathys. "The jury heard Micheatria's ordeal, felt her pain, and understood the significant harms and losses she endured. This money will allow her to receive the psychological care she desperately needs to try and live as normal a life as possible."

Unfortunately, Prince Embry was only 21 weeks old, was not considered viable and therefore not entitled to any independent recovery for wrongful death under Kentucky law.

Mathys, stated that the wrongful death law in Kentucky regarding the need to prove viability is archaic and unfair to pregnant mothers. "It allows the worst care to go unpunished, so that if the pregnancy fails to reach 24 weeks gestation, doctors cannot be sued for the infant's wrongful death."

Dr. Cheng has extensive experience in preparing and prosecuting patent applications before the U.S. Patent Office and the patent offices of countries in Europe, Asia and the Americas.
