Undeclared shipments of hazardous materials are predominately aerosols and flammable liquids (e.g., paint and paint-related materials), as well as batteries, fireworks, dry ice, perfume products, and cigarette lighters.

Before a hazardous material is transported in commerce, it must be properly classified, described, packaged, marked, and labeled as prescribed by the DOT Hazardous Materials Regulations (49 CFR). The DOT also mandates that all hazmat employees who "directly affect the safety of hazardous materials transportation" be trained and tested on these same regulations. Hazmat employees must have additional training on the IATA Dangerous Goods Regulations and IMDG Code if shipping by air or ocean.

To help the regulated community understand the rules for multimodal hazmat shipping, Lion Technology, the nation's leader in regulatory compliance training, is presenting a how-to training series on the DOT, IATA, and IMDG regulations. The U.S. Department of Transportation (DOT) has proposed a rulemaking that is aimed at tightening its lithium battery restrictions to eliminate regulatory exceptions for smaller shipments of lithium batteries. The DOT intends to increase packaging requirements and transport documentation, in addition to limiting the transportation of defective or damaged batteries. Manufacturers would be required to retain the results of their United Nations battery design-type test for each battery type. In addition, the proposed rulemaking would require that the pilot of an aircraft be informed if a battery shipment is being placed onboard the plane.

The seminar will cover the rules for ground, air, and vessel shipping under the U.S. Department of Transportation (DOT), International Air Transport Association (IATA), and International Maritime Organization (IMO). It is designed for employees and supervisors who perform pre-transportation functions, such as battery classification, packaging, marking, labeling, or completion of shipping papers. It also applies to those who ship electronics or other products that are packaged with batteries or contain batteries.

Lithium batteries are a versatile power source that has been adopted quickly by many different companies. As the number of lithium battery shipments has increased, so have the number of lithium battery incidents. Lithium batteries pose significant risk if not packaged correctly. When a lithium battery malfunctions due to mishandling, improper packaging, or inherent defects, the batteries generate extreme heat and cannot be easily extinguished. This poses great risk for those transporting the batteries, especially during air shipments.

The DOT mandates that all hazmat employees who "directly affect the safety of hazardous materials transportation" be trained and tested on the hazmat regulations applicable to their specific job functions and responsibilities. With civil penalties up to $55,000 per day per violation and criminal penalties up to $110,000 per day per violation, it is critical that lithium battery shippers receive updated training on the latest hazmat regulations.

While U.S. industries struggle to rebuild, today's union ironworkers are preparing to lead the next wave of new business construction. That's because amidst the economic challenges of the past several years the Iron Workers International Union (www.ironworkers.org) - teaming with the Ironworker Management Progressive Action Cooperative Trust (IMPACT) and the Ironworkers National Training Fund (www.ironworkers.org/organization/Apprenticeship.aspx) - has invested heavily in worksite-ready training programs for union ironworkers.

In March, the Iron Workers Union announced an unprecedented alliance with IMPACT (www.impact-net.org) and the Occupational Safety and Health Administration (OSHA) (www.osha.gov), designed to help foster a positive working relationship between union ironworkers and OSHA inspectors. The partnership establishes a "National Training Partnership" to revise existing steel-erection training materials, creating eight new training modules. OSHA compliance officers will undertake specialized training at locations across the U.S.

IMPACT Region VI labor co-chair Marvin Ragsdale says the Iron Workers Union's iron-clad commitment to the highest jobsite-safety standards helps protect ironworkers' health, and make jobs more profitable by reducing downtime and controlling injury-related costs.

Real-world results back-up the claim. For example, John Bosworth, president of Bosworth Steel Erectors Inc (www.bosworthsteel.com) and IMPACT Region VI management co-chair says "With union ironworkers on the job, we completed the Irving Convention Center, in Irving, TX, working 60,000 ironworker man hours without a single injury incident."

Results like these are especially worth touting in a time of increased government attention to on-the-job safety. In 2010, for example, OSHA has increased its monitoring and enforcement of safety regulations in the construction industry. Ragsdale explains that the Iron Workers Union's new training initiative enables OSHA inspectors to better evaluate how government safety standards are being met on the worksite-instead of relying on individual, varying interpretations of policy.

Year-round, the Iron Workers Union and IMPACT support training for union ironworkers-even between projects and through periods of unemployment. Through National Training Fund Regional Training Centers, ironworker instructors can attend train-the-trainer classes to help continually upgrade teaching skills.

Ironworker Joint Apprenticeship Training Committees (JATCs) provide multi-year apprenticeship programs to help train the next generation of union ironworkers. Ironworker apprentices compete in local, regional, and international events to demonstrate the skills they've learned. In June, the skills of a new generation of ironworkers were put to the test at the Iron Workers District Council of Texas and the Mid-South States District Council Apprenticeship Competition, hosted by Local 482 in Austin, TX, June 4-5.

Drawing contestants who won local competitions, the District Council Apprenticeship Competition comprises as many as eight skills tests. Each test measures proficiency in a different area of ironworking knowledge from welding to ornamental construction. These regional events prepare ironworkers for the biannual National Apprenticeship Competition (www.ironworkers.org/events/apprcomp.aspx), hosted by The National Training Fund and IMPACT. This year's event will be held in Seattle, WA, September 17-20, 2010.

Based on their achievements in Austin, and last year's competition in Houston, TX, two ironworkers from the District Council will compete against their peers from across the U.S. and Canada in Seattle this September. This year's competitors are Kyle George of Local 48 (www.ironworkers48.org), Oklahoma City, OK, who is currently employed by Allied Steel (www.alliedsteelerectors.com) in Oklahoma City, and Jake Crofford of Local 482 (www.ironworkers482.org), Austin, who is employed by Precast Erectors in Hurst, TX.

"These competitions provide a fun, yet practical way for union ironworkers to demonstrate proficiency in a controlled environment-with some healthy competition from their peers," says Greg Schulze, apprenticeship and training coordinator for the State of Texas. Business sellers can postpone paying thousands of dollars of taxes on the sale of their business if they use a special section of the U.S. tax code, according to Atlanta tax attorney Ricky Novak. Novak, president of Strategic 1031 Exchange Advisors, will describe the process for using 1031 exchanges at the July 27, 2010 meeting of the Georgia Association of Business Brokers (GABB).

The meeting of GABB, the state's only professional organization and Multiple Listing Service dedicated to buying and selling businesses and franchises, is free and open to the public. The speaker and meeting are on Tuesday, July 27, 2010, at the South Terraces Conference Center, 115 Perimeter Center Place, Atlanta, GA, 30346. Networking begins at 9:45 a.m. with a free light breakfast before the group's 10:30 a.m. meeting.

A 1031 exchange is named after a section of the Internal Revenue Code and was created to boost businesses.

"The provision gives business owners a way to buy and sell businesses without incurring what is often a significant tax liability," Novak says. "It keeps the economy going. It keeps people reinvesting in assets."

If an owner sells a business, real estate or other assets and purchases similar "like-kind" property within a certain amount of time, the owner can defer federal and state capital gains taxes. The provision applies only to business asset sales, and not transactions that primarily involve the sale of stock in a business, Novak said.

"When a client is selling a privately held family business, typically their biggest concern is replacing the cash flow or income generated by the business," said Novak. "Now that they no longer own the business, their main concern turns to replacing their income?"

Business sellers must place a value on the business, including the value of the real estate, personal property such as equipment, furniture and fixtures, and what is known as goodwill. Goodwill is the value added to a business because of their reputation, name, customer lists or other intangibles, and is fully taxable and not eligible for 1031 exchanges. But real estate and other personal property is eligible.

"Most business owners don't want to buy another business," says Novak. Many are nearing retirement and "don't want to be involved in running another business."

However, by using the strategy of a 1031 exchange, the owner could purchase an income-generating property, such as a shopping center or apartment building, Novak says.

The tax implications can be enormous. If the taxable gain in a building were $500,000, then the owner would owe $106,000 in capital gains taxes, including a 15 percent federal and 6 percent state taxes, Novak. The building might also be subject to tax liability through depreciation recapture, because the taxpayer would be liable to pay capital gains taxes on any depreciation of an asset he's taken over the years. But if the company used a 1031 exchange, using a qualified intermediary and invest that money into another property, they could defer those taxes.

Novak's primary business is 1031 exchanges and his clientele includes business brokers, domestic and international real estate investors and developers, domestic and international business owners, and domestic and international investors. Novak has handles 1031 exchanges on businesses and anything people hold as investments, including art, collectibles, racehorses, jets or boats. But the IRS rules for exchanges on real estate are much more flexible than those on other investments, Novak says.
