This is a record depth for Sharewell's state-of-the-art EM MWD technology.

Electro-Trac™ successfully steered and surveyed the above well to a measured depth of 13,065 feet (12,902 feet TVD) accumulating 700+ circulating hours without failure. This was accomplished without the use of repeaters or hard wiring. The Electro-Trac EM MWD was developed with initial funding from a Department of Energy (DOE) grant as part of the Deep Trek Initiative. Conventional EM MWD systems have depth limitations due to their inability to generate the required amplitude necessary to penetrate the increasing overburden of the surrounding geology, and/or detect and adequately filter the ambient noise. EM MWD technology is preferred over traditional, "mud pulse" MWD systems which require generation and subsequent acquisition of fluid pressure changes to transmit the required data. EM MWD saves operators substantial survey time which translates into cost savings for oil and gas operators.

Midwest Wind Energy Suspends Development Activity in Wisconsin

In view of continued regulatory uncertainty in the State of Wisconsin a leading wind farm developer has announced that it has suspended development activity until a more predicable climate can be restored. Chicago-based Midwest Wind Energy, LLC (MWE) has been developing utility scale wind farms in Wisconsin since 2003 and has two of its developed projects operating; one a 54-megawatt project in Dodge County and the other a 67-megawatt project in Fond du Lac County. MWE is also developing a 98-megawatt project in Calumet County and another project which had not yet been announced publicly.

According to MWE President, Stefan Noe, it no longer makes sense to invest significant development capital in a state that appears to be closed to the wind energy business. "Most states are clearly open for renewable energy development and the economic development dollars and jobs that come with it. So long as there are states rolling out the welcome mat it doesn't make sense to devote significant dollars to a state that is creating unreasonable roadblocks for wind development."

Noe cites the recent suspension of PSC 128 by the Wisconsin Joint Committee for Review of Administrative Rules as the most convincing evidence that Wisconsin is not interested in working with the highly lucrative wind energy industry. PSC 128 was the culmination of almost 2 years of work by the Wind Siting Committee and resulted in some of the most restrictive and detailed wind siting rules in the country. Although restrictive, these rules created a workable compromise between the wind industry and a range of stakeholders.

"Our four projects alone represent more than $600 million of capital investment in Wisconsin and more than 400 construction jobs and 40 permanent high-tech jobs. The industry as a whole has the potential to be a multi-billion dollar industry for the state. These projects also generate millions in local landowner payments and local government revenues, cash flow that is sorely needed in Wisconsin's rural communities." Noe said.

Cogent Technology Group, Inc. announced today that they are now offering a Data Distribution Service (DDS) of ERCOT Nodal data to market-participants in the ERCOT service region of the Texas electricity market. The service utilizes Cogent's Data Flow Manager (DFM) software to manage the extract data made available to market-participants on the ERCOT MIS portal. Cogent will maintain databases containing extract data for each market-participant client and will distribute new extract data periodically to the client in reports that are either emailed or made available via FTP.

Cogent's DDS service is a software service that is hosted in their Atlanta data center. ERCOT market-participants, who include Qualified Scheduling Entities, Load Serving Entities and Retail Electric Providers; subscribe with ERCOT for the provision of the data extracts and present Cogent with the needed digital certificates that provide access to ERCOT's data-download API on their behalf. The DDS service manages the periodic retrieval of any or all of the market-participant's many data extracts which are available on ERCOT's data portal. After download, the data is loaded into an ERCOT-defined database schema that is specific to the particular extract.

The DFM dashboard, which provides the user with a centralized view of the daily file-transfer and data-load activity, is a Web application accessible from any client computer on the public Internet. Specific extract data that is of interest to client personnel can then be queried and exported for local processing using canned reports developed by Cogent and made available for use on their Reports Server. The distribution of these reports, via email or FTP, can be set to run automatically on a regular schedule that is selected by the client.

Indigenous plaintiffs from the Peruvian Amazon won their appeal today in the landmark human rights and environmental contamination lawsuit against U.S. oil giant Occidental Petroleum (Oxy), as the U.S. Court of Appeals for the Ninth Circuit ruled that the case should be heard in Los Angeles, Oxy's hometown, EarthRights International announced today. A district court judge had previously ruled that the case should be litigated in Peru, but the Ninth Circuit disagreed, allowing the plaintiffs to proceed in federal court.

The lawsuit accuses Oxy of causing severe injuries by knowingly dumping a daily average of 850,000 barrels of toxic wastewater into the tropical rainforest inhabited by the indigenous Achuar people of northern Peru over a 30-year period, as well as inducing acid rain from gas flaring, and improperly storing waste in unlined pits. The plaintiffs allege that these outdated practices caused widespread lead and cadmium poisoning, among other serious health impacts.

"This is a major victory for the rights of indigenous peoples," said Marco Simons, Legal Director of EarthRights International (ERI), who argued the appeal before the Ninth Circuit. "Oxy will now face justice in the U.S. federal courts, rather than in a Peruvian legal system that has never compensated indigenous groups for environmental contamination." The Ninth Circuit's opinion indicates that it was not convinced of "the ability of the Peruvian courts to satisfactorily handle this case," citing corruption and "disorder in the Peruvian judiciary."

Atossa Soltani, Executive Director of Amazon Watch, added, "The Achuar people continue to suffer the devastating health impacts caused by Oxy's damaging practices, which were illegal in the U.S. at the time. This ruling means that the Achuar will finally get their day in U.S. court and signals the end of the era when companies could destroy indigenous communities and their environment with impunity." Amazon Watch has advocated for the Achuar people for many years, and joined the case as a plaintiff to challenge Oxy's allegedly fraudulent denials of responsibility for the pollution.

The Achuar case, Maynas Carijano v. Occidental Petroleum, No. 08-56187 (9th Cir.), was filed in May 2007 in the U.S. District Court for the Central District of California. In April 2008, the district court ruled that the case should be heard in Peru under the legal doctrine of forum non conveniens. The plaintiffs and their counsel, including Washington, DC-based ERI, the Venice, CA firm Schonbrun DeSimone Seplow Harris Hoffman & Harrison LLP, and San Francisco lawyer Natalie Bridgeman, appealed that ruling. The Ninth Circuit's opinion was issued by Judge Kim McLane Wardlaw, joined by Judge Mary M. Schroeder; Judge Pamela Ann Rymer agreed with part of the opinion and issued a partial dissent.

According to "A Legacy of Harm," a 2007 report issued by ERI, Amazon Watch, and the Peruvian legal non-profit Racimos de Ungurahui, Oxy's operations discharged billions of barrels of untreated wastewater into local streams, caused numerous spills and resulted in many unremediated toxic waste sites in Achuar territory, with severe health and livelihood consequences for the Achuar.
