AVONDALE, Ariz. - Aug. 10 (SEND2PRESS NEWSWIRE) -- After an investigation by Federal and State authorities for allegedly running a methamphetamine lab and unlawfully selling iodine at a feed and tack store, Southwest Feed, The State of Arizona has issued a temporary seizure order. Federal authorities have since dropped out of the investigation and returned the two cases of seized iodine and apologized after finding no evidence of any wrongdoing. The state of Arizona is still proceeding with the seizure.

The Plaintiff's first attorney, Jason Lamm, failed to reinstate the Plaintiff's claims and was dismissed. New attorneys for the plaintiff, Joseph Stewart and Dennis Bassi, filed an appeal on behalf of Universal Auto Center & Southwest Feed in appellate court (Case #CV06-0349), but were informed by Charles Johnson of the State of Arizona Attorney General's Office that the Court of Appeals had affirmed the Superior Courts' entry of the Judgment Order of Forfeiture and the subsequent denials of post-judgment relief.

The first judge, Barry Schneider, for unknown reasons dismissed himself from the case. The new judge denied the appeal (Case #CV06-0349) and allegedly told the plaintiff's attorneys, Dennis Bassi and Joe Stewart, that she had not read the appeal, but simply denied it.

Attorney Johnson and Katrine Nelson, also from the Attorney General's Office, were said to have offered $25,000 to the Plaintiffs attorneys to drop the appeals. Johnson and Nelson, allegedly, threatened Bassi and Stewart after leaving court.

Accordingly, the State of Arizona is now allegedly the undisputed land grabber of approximately $3 million in real property. In addition, the City of Avondale, for $150,000, purchased one of three parcels owned by the plaintiff at the corner of Dysart and Western.

Johnson had indicated that the City of Avondale was interested in purchasing the property on Dysart Road where Universal Auto Center & Southwest Feed is located. According to the plaintiff, this may explain the $15,000 in zoning fines and three years of alleged harassment from the City of Avondale.

Seizure and forfeiture laws are in place to punish and deny "criminals" any luxury or profit gained from their illegal activities, as well they should be.

The State of Arizona has seized all of the aforementioned property, under the forfeiture and seizure laws, in the interest of "justice." However, to this date, the plaintiff has not been charged with any criminal wrongdoing.

WINSTON-SALEM, N.C. - Mar. 28 (SEND2PRESS NEWSWIRE) -- Yesterday, a U.S. District Court judge unsealed a class action lawsuit (case #07cv00188) against Internet domain registrar RegisterFly along with the corporation charged with accreditation and oversight of registrars, the Internet Corporation for Assigned Names and Numbers ("ICANN"), among others. The lawsuit (Anne Martinez v RegisterFly, ICANN et. al.) filed by Attorney E. Clarke Dummit alleges that RegisterFly has systematically defrauded its customers who attempted to register or renew Internet domain names, causing them to lose their domain names, finances, and even entire businesses.

The lawsuit was initially sealed due to fears of retribution by RegisterFly.com towards plaintiff Anne Martinez for filing the suit, but since then other concerns have become more pressing, and the case was opened to the public.

Lead Plaintiff Anne Martinez fears that RegisterFly is likely to cause the loss of her website GoCertify.com, which is the primary source of support for her and her children. The GoCertify.com domain, which had a scheduled expiration date of March 18, 2007, according to Registerfly, could not be renewed (even though Anne was charged for the service of having that done), was refused transfer to a different registrar, and has had Anne's ownership information completely removed or concealed from public databases as well as made inaccessible to her. Martinez says, "If Medina illegally shuts down my registration, I could end up losing my business that has supported me for years, and even my home, and I am only one of thousands of people in this same situation. I can not just stand by and let this happen."

Long before the allegations of misuse of RegisterFly funds by company owner Kevin Medina for such things as escort service; a liposuction procedure; a penthouse apartment in Miami, Florida; and a $6,000 Chihuahua dog, RegisterFly had already earned a growing reputation for allegedly failing to renew or transfer domain names, respond to customer support issues, and double or triple charge for services never delivered. FFTL had asserted it was representing claims on behalf of a class. Certification of the Class Action Cross-Complaint filed by FFTL had previously been denied. As part of the Judgment, all of FFTL's asserted counterclaims and defenses were resolved in ABS's favor. In a Settlement Agreement attached to the Judgment, FFTL represented "that it agreed to be named as a representative party to the class claims on the basis of, and relied upon, representations made by [its original counsel], and that it now believes that the class action claims it asserted may have been without basis."

The Settlement Agreement also states: "Freedom deeply regrets breaching its contracts with ABS and infringing the ABS copyrights. Freedom was given the opportunity to settle the matter prior to the filing of the action and regrets not having taken ABS up on its offer." FFTL will wind up its operations and it has assigned to ABS certain preferred position rights. As a result of the lawsuit, FFTL also lost all rights to use THE MORTGAGE OFFICE.
